These Terms of Service ("Terms") govern your access to and use of the Model X Citizen website, member sites, and related tools (together, the "Platform"), operated by Model X Citizen ("we," "us," or "our"). By accessing the Platform or subscribing as a member, you agree to these Terms.
Model X Citizen is a membership-based software platform, website-hosting service, and curated professional directory for established working models and creative talent. We provide tools for members to build and host a professional website, present a portfolio and comp card, and receive inquiries directly from brands and clients.
We are not a talent agency, modeling agency, management company, or booking service. We do not procure, offer, promise, or attempt to procure employment or engagements for any member. We do not solicit, negotiate, arrange, or secure bookings, and we are not a party to any agreement between a member and a client. We do not act as an agent, manager, or representative of any member. Members deal with clients directly. Any representation a member has, with a talent or modeling agency or otherwise, is that member's own arrangement with a third party, and we are not a party to it.
Our only compensation is the membership fee for the applicable tier. We take no commission, booking fee, finder's fee, or percentage of any kind on any job, booking, campaign, or engagement a member obtains. Members keep 100% of what they earn from their work.
Any booking or contact form on the Platform simply transmits a prospective client's message to the member. We do not quote, counter, confirm, broker, or negotiate any booking. All discussions, terms, contracts, invoicing, and payment for any engagement occur directly between the member and the client, off-Platform. We are not responsible for, and disclaim any liability arising from, those dealings.
You retain ownership of the photos, video, text, and other content you upload ("Member Content"). You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, resize, and display your Member Content solely to operate and promote the Platform and your member site. You represent that you have all rights necessary to upload your Member Content and that it does not infringe any third party's rights. You are responsible for having appropriate rights and releases for any imagery you publish.
You agree not to misuse the Platform, including by uploading unlawful, infringing, or sexually exploitative content, impersonating others, attempting to access accounts or data that are not yours, or interfering with the Platform's operation. We may suspend or terminate accounts that violate these Terms.
We curate the member directory and may feature or order listings at our discretion, including based on membership tier. Inclusion in the directory is a visibility feature and does not constitute representation, endorsement, or any promise of work.
The Platform is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or secure, and we make no guarantee of any bookings, income, exposure, or results. To the fullest extent permitted by law, we disclaim all implied warranties.
To the fullest extent permitted by law, Model X Citizen and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of or relating to your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the amount you paid us in the twelve months before the claim.
You may stop using the Platform and cancel at any time. We may suspend or terminate access for violation of these Terms or as needed to comply with law. Sections intended to survive termination (including ownership, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify members. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, unless otherwise required by law.
